Welcome back to Workplace Wednesdays.

I am sure we’ve all watched an American TV programme where a senior person in a company turns to an employee and says -“you’re fired!”

This cannot happen in South Africa as the ending of an employment relationship - “firing”/dismissing/terminating - is strictly governed by law and rules and regulations which if ignored by the employer -puts that employer is serious breach of the law.

Still on the topic of sexual harassment in the workplace, we address the most difficult aspect if this serious issue – and that of proving the harassment. We must not ignore the requirement in law that the Employers are to create and maintain a working environment that is safe, and secure for all employees and the employer must ensure that the dignity and security of person for all employees, is ensured. If your workplace becomes hostile and threatening, then the employer has failed in its duty.

Welcome back to Workplace Wednesdays!

In the workplace – there is a form of GBV that is a “cancer” that can destroy work relationships and cause an atmosphere of fear and discomfort at the highest level – and it is called – sexual harassment.

In the workplace, there must be no tolerance or acceptance in any way of any form of this behaviour, as it is insidious and creates an atmosphere in the workplace that is totally unproductive and destructive at many levels.

Victory After Four Years: High Court Affirms Binding Nature of Settlement Agreements

After nearly four years of litigation, we are proud to share a significant victory in the High Court inDoor-O-Matic CC t/a Tight Fit Garage Doors v TD Motor Mania (Pty) Ltd and Another. This is a judgment that reaffirms important principles relating to settlement agreements and the conduct of litigants.

A special note of recognition must be given to our Mr Johan Eksteen, whose involvement in this matter was instrumental from inception through to conclusion. His steady guidance, strategic insight, and first-hand engagement in the settlement discussions ultimately proved pivotal in the Court’s assessment of the evidence.

This matter arose from a commercial dispute that, like many others, evolved into protracted litigation despite multiple attempts to resolve it. During the course of proceedings, the parties engaged in settlement discussions facilitated through their respective legal representatives. What followed is something many practitioners will recognise: an apparent agreement reached in principle, followed by a later attempt to resile from that position.

This judgment serves as a reminder of the weight that Courts attach to the integrity of settlement processes. Parties are expected to engage in negotiations in good faith, and once agreement is reached, they will be held to it.

We are grateful to have guided this matter to its conclusion and to have secured a just outcome for our client after a lengthy and challenging process.

Welcome back to Workplace Wednesdays.

In every employment relationship, which should be regulated by a contract of employment – there are duties and obligations placed on both parties (the employer and the employee).

One of the main obligations placed on the employer, is to NOT end the employment relationship unfairly or illegally. This means then that if the employer seeks to end the employment relationship, they must follow strict lawful procedures and have cogent reasons for wanting to terminate the employment relationship.

Of course, if the employee commits the misconduct again, then dismissal might be the only route to follow.
