Never before have delay claims assumed such importance in the construction industry. Delay analysis is a field of speciality that requires expertise. The purpose of this article is not to delve in depth in this area of low but rather to highlight the need to process delay claims in accordance with the agreement that regulates the relationship with your client. If you want to consider in more detail the science of delay I recommend that you read the Society of Construction Law’s Delay and Disruption Protocol.

Food for thought - FIDIC, the construction industry and the informal economy

Of particular significance for South Africa is what response should government have not only for the construction industry but the economy as a whole. It is clear that there is a need for economic stimulus given the severe economic challenges that we face in South Africa. In an article on money web dated 5 May 2020,[1] David Metelerkamp, a senior economist is quoted as saying “not only is the Covid-19 pandemic going to be the worst crisis since World War II, it is now widely expected to be the worst economic crisis/recession since the Great Depression of the late 1920s.” Furthermore the article states that between 120,000 and 140,000 jobs may be lost in the industry and that “In terms of these scenarios[2], activity levels in the construction industry will, at best, decline by 14.5% in 2020 and by 27.7% in the worst case scenario.”

Breaking News: Rule 41A comes into effect on 9 March 2020

In December 2019, the Rules Board for Courts of Law of the Republic of South Africa proposed the High Court Uniform Rule 41A. The Rule was gazetted on 7 February 2020 (page 31) and comes into effect on 9 March 2020.

The rule is expected to change South Africa's litigation system, putting mediation in the spotlight as the mainstream mechanism for resolving disputes.

FHBC identified some highlights of what High Court Rule 41A entails:
Parties are required to specifically indicate whether they consider mediation to be possible (or not, along with reasons for either consideration) when issuing summons or when delivering a plea.
The parties have to deliver a joint minute, documenting their mutual agreement that the dispute may be referred to mediation.
While mediation is in progress, time limits to deliver pleadings are suspended.
Where multiple parties are involved in the litigation process, it will be possible for only some of the parties to proceed to mediation.
The confidentiality and admissibility of documents is taken into consideration.
A joint memorandum indicating the outcome of the mediation must be submitted.
Cost orders may be given for the costs of the mediation proceedings.
Rule 41A is not specific to any type of dispute, but applies to all disputes brought before the High Court.
