This week, let’s unpack the difference between a Letter of Authority and a Letter of Executorship in deceased estates.

When a loved one passes away, their estate must be reported to the Master of the High Court. Depending on the value of the estate, different letters are issued:

Letter of Authority
This is issued where the total value of the deceased estate is R250 000 or less.

- The process is simpler and less formal
- No Liquidation and Distribution Account is required
- The appointed person (representative) administers the estate under the Master’s direction

Letter of Executorship
This is issued where the estate value is above R250 000.

- A formal executor is appointed
- A Liquidation and Distribution Account must be prepared
- The account must be advertised for inspection before final distribution

Understanding the difference is important, as it determines the process, costs, and time involved in administering an estate.

Buying a House? Don’t Overlook This Important Document!

A Deed of Sale (also known as an Offer to Purchase) is not just paperwork — it is the foundation of your entire property transaction.

It is a written, legally binding agreement between the buyer and the seller that sets out:
1. The purchase price
2. Details of the parties
3. Description of the property
4. Payment terms (cash or bond)
5. Important conditions (e.g. subject to bond approval)

Once signed by both parties, it becomes legally enforceable.

Why is this important?

Neither the buyer nor the seller can simply walk away without consequences.

✔️ It protects your rights
Everything is clearly recorded to avoid misunderstandings and disputes.

Can You Sell an RDP House? Let’s Talk About It!

A question we get often is: “Can I sell my RDP house?”
The answer is YES — but there are important rules you need to know

You CAN sell your RDP house if you are the registered owner. However, you may only freely sell your RDP house after 8 years from the date you became the owner.

What if it’s before 8 years?
If you want to sell before the 8 year period has passed, you cannot sell it directly on the open market.

Instead, you must:
-First offer the property back to the Department of Human Settlements. The Department will then decide whether to take it back or grant consent for you to sell

If consent is granted, it will be submitted together with the transfer documents at the Deeds Office.

Today let’s discuss the difference between TRANSFER FEES/COST and TRANSFER DUTY:

Transfer fees/costs: fees payable to a conveyancer attending to the transfer of ownership over an immovable property. Such fees also include deeds office fees.

Transfer duty: Fees payable to SARS wherein the value or the purchase price of the property is for an amount of R1 210 001 or above, unless exempted.

All these fees are paid by the transferee (i.e the person receiving the property or buying the property)
