Artificial Intelligence and E-Commerce Customer Data Protection in South Africa: A Regulatory Perspective
AI is transforming the e-commerce industry by enabling businesses to personalize customer experiences, automate services, detect fraud, and improve decision-making. While these advancements offer significant benefits, they also involve the collection, processing, and analysis of vast amounts of personal information. This raises important concerns about privacy, data security, transparency, and accountability.
In South Africa, the protection of customer data is primarily governed by POPIA, supported by the Electronic Communications and Transactions Act and Cybercrimes. Although these laws provide a strong foundation for data protection, they were not specifically designed to address the unique challenges posed by modern AI technologies. As AI systems become more sophisticated, questions arise regarding automated decision-making, informed consent, algorithmic bias, and responsibility when personal data is misused.
What's the impact of AI on customer data protection within South Africa's e-commerce sector, Is the current legal and regulatory framework sufficient to safeguard customers while promoting innovation. There is need to explore international best practices and propose recommendations for strengthening SA's approach to AI governance, ensuring that technological advancement is balanced with the constitutional right to privacy and the protection of personal information.
