WHAT ARE THE DIFFERENT TYPES OF WORK VISAS ONE CAN APPLY FOR?
There are three main categories of work Visas one can apply for:

1. General Work Visa
A general work visa can be applied for and issued to a foreigner who has received an offer of employment in South Africa. Prior to the actual application for a general work visa with The Department of Home Affairs, the prospective employer needs to apply for and be issued with a certificate from the Department of Labour. Here the employer would need to satisfy the Department of Labour that despite a diligent search, no suitably qualified South Africa citizen or permanent resident could be found to fill the position.

2. Critical Skills Work Visa
A critical skills work visa can be issued to a foreigner who possesses skills or qualifications determined to be critical for South Africa. The main advantage of being able to apply for a critical skills visa is that there is no need to submit a certificate from the Department of labour.

3. Intra-company Transfer Work Visa
Intra-company transfer work visas are issued to individuals that are employed by companies or institutions that have offices or branches abroad as well as in South Africa or who are employed by an overseas company that has an affiliation to a South African company or business.

WHO CAN APPLY FOR A RELATIVE VISA?
A relative visa can be issued to a foreigner who is a member of the immediate family of a citizen or permanent resident of South Africa.



WHAT IS AN IMMEDIATE FAMILY MEMBER FOR THE PURPOSES OF A RELATIVE VISA APPLICATION?
Any family member that is within the first degree of kinship. This includes spouses, parents and children. Although not considered to be in the first step of kinship, grandparents, grandchildren and siblings may also apply for a Relative Visa.



HOW LONG IS A RELATIVE VISA ISSUED FOR?
A relative visa may be issued for a maximum period of 2 years and may be renewed one or more times.

A business visa may be issued to a foreigner intending to establish or invest in, or who has established or invested in a business in South Africa.



WHAT IS THE MINIMUM FINANCIAL INVESTMENT REQUIRED?
The minimum financial investment required in order to qualify for a business visa is R5 Million Rand.

As a manager within the Immigration Component of Home Affairs, Richard was actively involved in numerous management forums, including the quarterly National Immigration Branch meetings chaired by the Deputy Director General for Immigration Services of the Department Home Affairs – a position that granted him a unique understanding of the strategic objections of the Immigration Branch, knowledge that today can be applied to the utmost benefit of his clients. It is with over a quarter of a century of experience within the Immigration Branch of Home Affairs that Richard has decided to embark on the new challenge of providing assistance to clients in the private sector.

Richard has acquired unparalleled knowledge and experience in all Immigration matters in South Africa. I DID NOT RENEW MY VISA ON TIME, WHAT CAN I DO?

A foreigner that is unable to renew their visa on time whilst in South Africa will find themselves in the difficult position of not having a current status in the Republic. In terms of the Immigration Act, such foreigner will be deemed to be illegal in the country and will be subject to detention and deportation. Additionally, whilst the said foreigner does not have a current status, they may not apply for any visa or permit through the Department.

However, if such an individual has not already been detained or ordered to depart the country, they may submit an application to the Department requesting a temporary legalisation of their stay. This process is informally referred to as a “Good Cause” application.

Declarations of undesirability are most commonly issued by the Department for travellers that have overstayed the validity periods of their visas whilst in South Africa. A permanent residence permit may be issued to a qualifying applicant that is able to meet the requirements set for the specific category of permit applied for.
