Creating a business: When do you need to involve your IP attorney?
Over the last year, the world has seen some drastic changes in the economy due to Covid-19. Business suffered or even closed – and not due to mismanagement or fault of the owners.
What this has created is a parallel economy where unfortunate job losses and the like flooded this parallel “new” economy with skills that left the “primary” economy. As a result, people will start putting their skills to use in creating businesses again.
Once these businesses are created, the intellectual property of the creators comes into play. We have seen on numerous occasions that an IP attorney is not involved in the creation stage as the mindset of business owners is currently that an attorney is only involved when there is trouble.
The cry of this article is to change that mindset!
If you created a brand for your business, there is a lot of time, effort, and money going into the creation and commercialization thereof.
We have seen numerous business owners panting at their IP attorney’s door for help because they have been drawn into proceedings for infringing a brand they never knew existed. As a result, you find yourself fighting an unwanted battle at a cost not budgeted for.
So, the question is – When do I involve my IP attorney? Simple – as soon as your new brand has been created.
Your IP attorney can do a quick trade mark search and advise if your new brand will infringe on already existing brands in the market.
