You may have heard the buzz around the PoPI Act but did you know that is applies to individuals running small business, practitioners or consultancies.
POPI is South Africa’s data privacy law. The Act governs when and how businesses collect, use, store, delete and manage personal information. The operative provisions of the Protection of Personal Information (PoPI) Act came into force on the 1st of July 2020 and you will have now have 2 months to be compliant. Depending on the seriousness of the breach, the POPI Act makes provision for fines of up to R10 million and a jail sentence of up to 10 years. Considering the severity of these penalties, it is imperative that you, understand the requirements as a business owner as you are ultimately responsible and will bear the brunt of any non-compliance.
