Under South African law, a Power of Attorney allows an agent to act on behalf of the principal. However, it becomes invalid in the following situations:

Loss of Mental Capacity: If the principal becomes mentally incapacitated- such as in cases of dementia or other cognitive impairments - the Power of Attorney is automatically revoked. The agent can no longer act on behalf of the principal unless the court appoints a guardian or curator to manage the principal’s affairs.

Death of the Principal: The Power of Attorney is automatically revoked upon death.

Revocation or Expiry: If revoked or expired, the Power of Attorney is no longer valid.

Acting under an invalid Power of Attorney can result in personal liability, including damages or criminal charges.

It’s important to review your Power of Attorney regularly, particularly if mental incapacity is a concern. Appointing a trusted agent and considering options for managing affairs in case of incapacity is crucial.
