COURT RULES FOR EQUALITY: In terms of the common law rule – lex domicillii matrimonii – the proprietary consequences of a marriage was determined by the husband’s domicile at the time of marriage, for instance if the husband was domiciled in England at time of marriage, the English law would apply to the marriage.

In the recent judgment of N.P. vs Minister of Justice and Constitutional Development dated 23 June 2026 – the Court declared this common law rule unconstitutional due to unfair discrimination based on s*x / gender and developed the common law principal with alternative applications.
