Itโs useful to know whatโs involved in the Road Accident Fund claims process so that if you have a claim, you know what to expect.
Once your attorney submits a claim, the Road Accident Fund (RAF) registers the claim on its system.
It then has 120 days to conduct its own investigation of the claim.
However, once this period has passed, your attorney can issue a summons to the Road Accident Fund. This informs the Fund that you plan to pursue your claim in court.
As part of the claiming process, you might be required to undergo examination by medical experts that the Fund appoints and the medical experts your attorney appoints .
After it has investigated a claim, the RAF may offer you a settlement. Accepting the offer means you wonโt have to go to court.
However, in many instances, RAF settlement offers are unreasonably low. They may represent only a small percentage of the amount that a court would award you.
If no settlement offer is made or you refuse the offer, a RAF claim goes to court.
The judge will hear all the evidence, including expert medical testimony.
The judge then determines whether the claim is valid and the amount of any compensation to award.
RAF claims can take anywhere from three to six years, or even longer, to finalise.
