HOW TO MITIGATE ISSUES IN A DIVORCE
There can be no doubt that divorce proceedings cause animosity and adverse emotions. When you do not have a clear picture of facts vs emotions, your vision is blurred. In order to reduce conflict, it is essential to keep the following aspects in mind when entering into negotiations:
- Keep communication focused and respectful;
- Aim for business-like conversations about issues, not about past hurt;
- Use "I" statements and avoid blame;
- If conversations become too heated, use email or a mediator;
- Respect keeps doors open for compromise;
- Prioritize the best interests;
- If children are involved, put their stability, routines, and wellbeing first;
- For assets, focus on fair division as opposed to "winning."
- When both parties focus on long-term outcomes vs short-term solutions, it comes faster;
- Get clarity on facts early and separate the facts from emotions;
- Make a clear list of assets, debts, income, expenses, and parenting needs;
-Obtaining documents, valuations, and a realistic budget reduces arguments based on assumptions;
- Be transparent, it builds trust, even in disagreement;
- If there is a deadlock, consider mediation, or a parenting coordinator to assist with practical issues;
- A neutral third party can help you find middle ground and draft working agreements;
- Separate legal, financial, and emotional issues;
- Address concerns regarding immovable property, bonds, custody, maintenance;
- Create a budget
