Be informed! 🔓📚‼️

A precedent for domestic workers’ rights have been established in South Africa, affirming that security measures must not undermine fundamental human rights.

At Eagle Canyon Golf Estate, body and bag searches of domestic workers and garden staff were challenged after a homeowner accused the searches of being racist and xenophobic. The estate’s homeowners’ association defended the searches as: random, limited to bags searches only, and lawful as they were permitted under a disclaimer posted at the estate entrance.

The South African Human Rights Commission (SAHRC) became involved and determined that the searches violated the domestic workers’ constitutional rights, including the right to equality, dignity, and privacy. The searches were found to humiliate staff, reinforce stereotypes, and perpetuate social inequalities.
�The SAHRC directed the homeowners’ association to cease the searches and to implement new security protocols that respect human rights.

NB ‼️ It is the responsibility of employers and estates to find solutions that balance security requirements with respect for dignity and privacy.
