UPDATE: letter sent to MEC

It has come to our attention that several residents are unhappy with the sudden change in the municipal rates and did not have any notice as required by law from the Municipality/
Section 49(1) of the Municipal Property Rates Act (“MPRA”) deals specifically with the valuation roll.
Once the municipal valuer has submitted the certified valuation roll, the municipal manager must, within 21 days, comply with the requirements in section 49.
Section 49(1)(c) provides that the municipality must:
• serve on every owner of property listed in the valuation roll a copy of the notice referred to in section 49(1)(a), together with an extract of the valuation roll pertaining to that owner's property.
The service must be by:
• ordinary mail; or
• where appropriate, in accordance with section 115 of the Municipal Systems Act.
Section 115(1) states that:
• A notice or other document served on a person under the Systems Act, or by a municipality under any other legislation, is regarded as having been served when:
(a) it is delivered to the person personally;
(b) it is left at the person's residence or place of business in South Africa with a person apparently over the age of 16;
(c) it is sent by registered or certified mail to the person's last known residential or business address in South Africa and an acknowledgement of posting from the postal service is obtained;
(d) if the person's South African address is unknown, it is served on that person's agent or representative in South Africa in one of the ways in paragraphs (a), (b) or (c); or
(e) if both the person's address and agent/representative are unknown, it is posted in a conspicuous place on the property or premises to which the notice relates.
Compliance with section 49 is a jurisdictional prerequisite for a valuation roll to take effect under section 32(1)(a) of the MPRA. Without compliance with section 49, the valuation roll cannot validly commence, and rates levied pursuant to such a roll are unlawful
