Our client, a local tavern owner (foreign national) and first-time offender, was facing serious charges of Assault with Intent to Cause Grievous Bodily Harm (GBH). The State’s case relied on a single witness version that was highly contradictory. By meticulously analyzing the objective medical evidence (the J88 forms), our defense team (lead by the Director Mr Rayi) demonstrated to the Court that the physical injuries did not align with the State's timeline. Furthermore, we exposed massive concessions during cross-examination that proved our client's version was reasonably possibly true.
Today, the Magistrate agreed with our submissions and found our client NOT GUILTY.
This case highlights a fundamental principle of South African criminal law: the State must prove guilt beyond a reasonable doubt, and objective medical facts cannot be ignored.
