In this judgment, the Johannesburg High Court declared that the customary law custom of handing over the bride to the bridegroom's family as an essential pre-requisite for the lawful validation and the lawful existence of a customary law marriage is not a lawful requirement for the existence of a customary law marriage when section 3 (1) of the Recognition Act have been complied with. The court wrote: "a customary law marriage wife effectively has no freedom of opinion, autonomy or control over her marital life if her customary husband's family insists that her family should hand her over in order to validate the existence of her customary law marriage in spite of the fact that she and her customary law husband have complied with section 3(1) of the Recognition Act."

Today, the Constitutional Court of South Africa unanimously confirmed the order of constitutional invalidity of certain legislative provisions dealing with the use, possession and cultivation of cannabis. The order of constitutional invalidity was suspended for 24 months to allow Parliament to correct the constitutional defects in these provisions, but has granted immediate relief by reading in certain words into the relevant legislation.
In effect, the judgment decriminalises the use, possession and cultivation of cannabis by an adult in his/her own private home for his/her own personal use. However, the judgment does not make any changes to the law relating to purchase of cannabis.
