A will is a legal document outlining how a person's assets and liabilities should be managed and distributed after death.

Administration of an estate involves managing the deceased's assets, paying debts, and distributing the remaining balance to the rightful heirs.

*Will and Administration of Estates* .

*Will* :
A will is a written document that specifies how a person's assets and liabilities should be handled after death. It can also nominate an executor, who is responsible for administering the estate.

*Deceased Estate* :
A deceased estate encompasses all the assets and liabilities of a person who has died. This includes property, money, bank accounts, pension funds, and debts.

*Administration of Estates* :
This process involves collecting the deceased's assets, paying outstanding debts and taxes, and then distributing the remaining balance to the designated heirs as per the will or the laws of intestate succession if no will exists.

*Importance of a Will* :
Having a will allows individuals to control how their assets are distributed, nominate guardians for minor children, and specify who will manage their estate. Without a will, the deceased's assets will be distributed according to the rules of intestate succession, which may not align with their wishes.

*Reporting a Deceased Estate:*
When someone dies, their death must be reported to the Master of the High Court within 14 days. This can be done by anyone who possesses property or the will of the deceased, such as a spouse, family member, or an appointed legal representative.

*Letters of Executorship* :
If the estate value exceeds R250,000, the Master of the High Court may issue Letters of Executorship to the executor, authorizing them to administer the estate.

*Letters of Authority* :
If the estate value is less than R250,000, Letters of Authority may be issued under the small estates procedure.

*Intestate Succession* :
If a person dies without a will, their estate will be distributed according to the rules of intestate succession, as outlined in the Intestate Succession Act, 81 of 1987.

You want to file for divorce but don’t know where to begin?

Consult with a divorce lawyer who can provide you with specific legal advice as to how best you can approach the matter.

Your lawyer will request your details and those of your spouse, the date, time and place of the marriage and details of the matrimonial property regime (together with the marriage certificate or a copy), the details of any minor children, your instructions for care, contact and child maintenance for any minor children, your instructions for any spousal maintenance and the details of any other specific issues.

This information allows your lawyer to draft divorce summons which will be personally served on your spouse by the Sheriff as required by the Divorce Act.

And in that way you have initiated your divorce proceedings.

You are unclear whether you qualify to claim from RAF or not? this is what you must know.

1. Who qualifies to claim from the Road Accident Fund?

People who are seriously injured in a motor vehicle accident that occurred within the boarders of South Africa, including drivers, passengers, motorcyclists, cyclists and pedestrians can claim compensation from the Road Accident Fund.

Moreover, dependents whose breadwinner is killed in an accident can also qualify to claim.

2. What can you claim from the Road Accident Fund?

Victims of road accidents can claim for medical expenses, loss of earnings and, in cases involving serious injury, general damages for pain and suffering.

In an event that a breadwinner in your family is killed in a road accident, you can claim for loss of support and funeral costs.

3. Time limits to lodge a claim

A claim against the Road Accident Fund must be lodged within three years from the date of the accident or within two years if the identity of the driver or owner of the vehicle who caused the accident is unknown ( hit and run).

If you want to claim or you have been waiting for years and your claim has not been paid, we are here to assist you.

It is a general rule that both parents have a legal obligation to maintain their child. However, some parents find themselves using a forceful hand for child support⚖️

1. What is Child Support?

Child support is the legal obligation of parents to financially contribute to their child's upbringing following a separation or divorce, ensuring their basic needs are met.

2. Who must pay for child support?

Generally, the non-custodial parent is responsible for paying child support. This is the parent who does not reside with the child.

3. What if the other parent is unwilling or inconsistent with the payment of child support?

It is highly recommended that you work with a reputable lawyer who understands child support and discuss the financial needs of the children and agree on an amount with which you are comfortable and a legal action can be taken against the unwilling parent.

If you need assistance with claiming for child support, do not hesitate to contact us.
