If your will still leaves part of your estate to your spouse, they may still inherit from you after your death if your will is not updated.

During divorce proceedings, updating your will can help ensure that your estate is
dealt with according to your current wishes. Once your divorce is finalised, South African law gives you a 3-month period where it is generally presumed that you did not intend for your ex-spouse to inherit.

However, if more than 3 months pass after the divorce and your will has not been
updated, your ex-spouse may still inherit if they are named in your will.

To avoid uncertainty, it is important to keep your will up to date, especially during or after a divorce.

Receiving a summons or subpoena from SAPS is something you should take seriously.

A criminal summons requires the person named in the document to appear in court in connection with an alleged offence. The offence, court and date will be listed on the document.

A subpoena means you are required to appear in court as a witness. You are not being accused of a crime, but you are still legally required to attend.

In both cases, check the details carefully and make sure you are at the correct court by 𝟬𝟴:𝟯𝟬. Once there, you must wait until your name is called or until the court excuses you. Failing to appear can lead to legal consequences, including a warrant being issued for your arrest.

In most property sales, the seller usually appoints the transfer attorney.

This is because the seller is the person transferring the property from their name into the buyer’s name.

Even though the buyer often pays the transfer costs, the appointment of the conveyancer is usually handled by the seller, unless both parties agree otherwise.

As the buyer, you are still allowed to ask questions, request updates, and get independent advice if you need clarity before signing or during the process.
