No such thing as a "casual worker"

Employers regularly refer to certain employees as "casual workers" inferring that they are not protected by the Basic Conditions of Employment Act. This is a dangerous myth as the definition of “casual labourers” which was previously defined as employees who worked for 3 days or less per week, fell away with amendments to the Basic Conditions of Employment Act in 1997.

Employees who work for less than 24 hours per month are excluded from the Basic Conditions of Employment Act protections, including contracts, hours of work, overtime pay, leave, sick leave, termination, etc. It is however crucial to note that an employee working for an employer for 24 hours or more per month, irrespective of whether called a casual worker, fall under the Basic Conditions of Employment Act provisions.
