We're looking for a Foreclosure Litigation Secretary to join our Durbanville team in a full-time capacity to manage high-volume, end-to-end foreclosure matters on behalf of institutional banking clients.
Role Overview
The successful candidate must be able to independently run foreclosure files in strict compliance with bank mandates, SLAs, and the Uniform Rules of Court, from letter of demand
and summons stage through Rule 46A applications and sale in ex*****on.
Key Responsibilities
* Independent drafting and management of all foreclosure
pleadings, including:
- Simple and combined summonses� - Particulars of Claim
- Notices of Bar, Applications for Default Judgment
- Rule 46A applications (affidavits, schedules, valuation
packs, and annexures)
- Sale in ex*****on documentation and instructions
* End-to-end management of bank foreclosure files in
accordance with panel mandates
* Ensuring full compliance with:
- Uniform Rules of Court
- Bank-specific policies, precedents, and turnaround times
(SLAs)
- National Credit Act requirements where applicable
* Managing high-volume matters across multiple High Court
jurisdictions
* Liaising with:
- Bank representatives and recoveries departments
- Advocates and correspondent attorneys
- Sheriffs and Deeds Offices
* Maintaining accurate reporting and status updates in line with
bank requirements
* Diarising litigation time periods and managing court deadlines
* Preparing compliant, indexed, and paginated court bundles
* Invoicing
Minimum Requirements
* 3 – 5 years’ experience as a litigation secretary, with
substantial bank foreclosure experience
* Proven experience working on bank or institutional creditor
panel matters
* In-depth knowledge of:
- Foreclosure litigation process
- High Court practice and procedure
- Uniform Rules of Court
* Ability to manage high-volume files with minimal supervision
* Strong drafting, organisational, and time-management skills
Advantageous
* Experience across multiple provinces / High Court divisions
* Prior exposure to major South African banks’ foreclosure
mandates
* Familiarity with electronic court filing systems
