Family and divorce law is about more than documents, legal positions and what happens in court. It’s about people.

Hurt, fear, anger, control and resentment can all shape the way a dispute unfolds. Understanding those dynamics can be just as important when deciding how best to approach a matter.

At Benita Ardenbaum Attorneys, we believe emotional intelligence and legal strategy should work together.

How much do you think understanding the person across the table can change the way a dispute is handled?

Thinking about divorce and deciding to get divorced are not always the same thing.

Sometimes the first step is simply understanding what your position looks like: Your finances, your children, your matrimonial property regime, and the practical implications of the decisions ahead.

You don’t need to have everything figured out before speaking to an attorney. In fact, getting advice early can give you the clarity you need to make more informed decisions about what comes next.

In this video, Benita shares what she believes you should consider first.

If divorce is something you’re considering, contact Benita for a consultation that’ll answer all your questions: https://benitaardenbaum.com/contact-us/.

You don’t need to make every decision today. Start by understanding your options.

When a business forms part of a divorce, the conversation can extend far beyond who owns what.

How the business is valued, how shares are held, the income it generates and the matrimonial property regime can all become relevant - alongside a question that is sometimes overlooked: what happens to the business next?

For business owners, shareholders and their spouses, decisions made during divorce can have implications for both the financial settlement and the future of the business.

Getting specialist advice early can help you understand your position, identify potential risks and make informed decisions before they become difficult to undo.

When a family or divorce matter becomes emotional, it’s very easy to act first and think about the consequences later.

Sending the message. Moving the money. Making a threat. Posting online. Agreeing to something simply because you want the conflict to stop.

But decisions made in the heat of the moment can make an already difficult situation more complicated.

Before you react, get clarity. Understanding your position first can help you make decisions that are considered, strategic and in your best interests.

If you’re facing a family or divorce matter and aren’t sure what your next move should be, contact Benita Ardenbaum Attorneys to arrange a confidential consultation. https://benitaardenbaum.com/contact-us/

When a divorce keeps dragging on, it’s easy to feel as though you’re simply waiting for something to change.
But time passing and progress being made aren’t always the same thing.

Sometimes a matter is genuinely complex. Sometimes there are obstacles that need to be resolved. And sometimes it’s worth asking whether the current approach is actually moving you towards an outcome.

If your divorce feels stuck, it may be time to understand why, and what can realistically be done next.

Contact us to arrange a consultation and get clarity on your matter - https://benitaardenbaum.com/contact-us/

Is your divorce taking longer than you expected?

Mediation can be incredibly valuable, but it isn’t the right solution for every family or divorce matter.

For mediation to work, there needs to be a genuine willingness to engage in the process. When that isn’t possible, continuing to push for agreement can sometimes create more delay rather than progress.

Going to court doesn’t necessarily mean a matter has “failed.” Sometimes, it is the appropriate next step to move things forward.

The right approach depends on the circumstances, the people involved and what ultimately needs to be achieved.

If you’re unsure whether mediation or litigation is appropriate for your situation, contact us to arrange a confidential consultation.

The goal isn’t to avoid court at all costs. It’s to choose the right strategy for the matter in front of you.

We’re proud to have been represented by Benita at She Shows Up, hosted by FNB Women in Business in collaboration with the Durban Chamber of Commerce and Industry.

Invited to join the panel, Benita had the opportunity to step beyond the legal world and share something far more personal - her own story, the experiences that have shaped her, and some of the realities behind building a career and business over the years.

It was an afternoon of honest conversation, shared experiences and women speaking openly about what it really takes to keep showing up.

Thank you to FNB Women in Business and the Durban Chamber of Commerce and Industry for inviting Benita to be part of such a meaningful conversation, and to the incredible women who shared the panel with her.

A proud moment for Benita and for all of us at BAA.

Legal aid will not always cover family law, but that does not mean the door is closed. ⚖️ You can handle maintenance, children's court, and even divorce matters yourself at the magistrate's or regional court. Here is how to get started:

1️⃣ Speak to the court clerks. They can guide you through the process.
2️⃣ Do your homework. Research your specific matter before you go.
3️⃣ Visit the right court. Magistrate's court for maintenance and children's matters, regional court for divorce.

It takes effort, but it is a real path forward when funds are tight.

Co-parenting communication can be the most difficult. It's difficult to switch off your anger, resentment, and disappointment, and sometimes it's difficult just to have a normal conversation about logistics.

If this is your reality, there's a practical route out. The High Court can order that all communication between co-parents runs through a dedicated app such as OurFamilyWizard, Sync-in or Coparent.

This can be written into a parenting plan or granted as a court order; it becomes legally binding. Send this to someone who needs this!

18/08/2026

You've heard the warning: take your matter to the High Court and the costs will bury you. ⚖️ But here's what nobody mentions about the lower courts. Every postponement, whether it's a missing official, an ill witness or load shedding, means paying again. Attorney appearances, advocate fees, preparation, all of it, on repeat.

The High Court offers something the lower courts often can't: finality. Your matter is heard, resolved and closed, without the emotional drain of proceedings that stretch on for years.

Simone Adler, Family Law Attorney and FAMAC-accredited mediator at BA Attorneys, explains why the High Court might be the more practical route for your matter.
Ready for resolution, not repetition? Schedule a consult with us today.
