Vat and B-BBEE Procurement
As of the 1st of April 2018 Vat has increased by 1% from 14% to 15%. Apart from the implications on the economy this has also had an effect on the B-BBEE Procurement element. Please be cautious and ensure that when you submit supplier spend for B-BBEE purposes that you have excluded the right Vat percentage over the period. Do not normalize or average to 14% or 15% as this will result in total spend figures not agreeing back to ledgers or invoices.

Sector Codes for the Defence Sector have been gazetted on the 9th of November 2018.
The Defence Sector Charter applies from the date of gazette and is applicable to all companies who operate within the South African Defence industry (SADI), public and private enterprises, including entities that supply goods and services to the state as well as state-owned enterprises, national and provincial departments.
The Revenue Thresholds are as follows:
EME’s Revenue of R5mil or less
QSE’s Revenue R5 million or more but less than R50 million
Subminimums for priority elements also apply; A Large Enterprise is required to comply with all the priority elements and a QSE is required to comply with Ownership as a compulsory element and either Skills Development or Enterprise and Supplier Development.
A Sector Charter Council will be appointed to monitor implementation of the sector code and to conduct regular reviews.

YES, Practice note

The practice note for the implementation of the Y.E.S (Youth Employment Service) Initiative has been issued in terms of the Amended Code Series 000, Statement 000 of the Amended Codes. The Department of Trade and Industry (dti) published the Youth Employment Service (YES) Initiative as Notice 502 in Gazette 41866 on 28th August 2018. The YES Initiative enables any organization, EME, QSE or Generic to enhance its B-BBEE Level by 1 or 2 levels by providing jobs for young black people under the YES Initiative.

The BBBEE Commission released a statement on the 5th of July 2018 clarifying that no EME certificates/affidavits are to be issued by Verification Agencies or Accountants. EME’s and qualifying QSE’s should only use affidavits unless they opt for a complete verification on the QSE or Generic scorecard. The BBBEE Commission stated that “Government introduced this mechanism specifically to reduce the cost of doing business and regulatory burden for these entities and the template for the sworn affidavit is available at no cost on the website www.thedti.gov.za or EME certificates at CIPC from www.cipc.co.za.” More information and a list of invalid certificates are available from the BBBEE Commission’s website.
