Sellers — is it okay to give verbal acceptance on an open mandate to list and sell your immovable property?
It’s not illegal… but is it a good idea?
Is it a good idea to have a verbal lease agreement?
Is it a good idea to have a handshake agreement when you sell your car?
Here’s the reality: as a seller you could land up in very hot water. Two different agencies could each claim they were the effective cause of the sale — and both could come after you for estate agent’s commission.
Remember, you already have to sign the Seller’s Mandatory Disclosure form telling the purchaser about the defects. So you’re signing documents anyway.
At the very least — sign the mandate. Protect yourself.

Buyers Tip from Joy Clover | Conveyancing Attorney at CLS LAW
When you get a mortgage bond, treat it like a fragile flower.
Nothing must change its status quo.

That means:
❌ Don’t take money out of your credit cards
❌ Don’t borrow money for bond costs
❌ Don’t buy a car
❌ Don’t change your marital status
Any of these can trigger the bank to re-assess your home loan application. Keep everything exactly as it was when the bond was approved — no new debt, no big purchases, no change in marital status.

SMALL CLAIMS COURT claims have increased to R30 000.00

As of 1 August 2026

You can file a claim and you don’t require legal representation

You can claim damages up to R30 000.00

This is really great news because you can resolve civil disputes quickly and without the expense of legal representation. Note only a natural person and not a CC or Trust or Pty Ltd can sue out of the Small Claims Court.
