When the agreement is tested, the drafting must speak for itself.
In 2024, I was approached to structure a complex sale agreement for immovable property. As with many property transactions, everything looks straightforward — until it is not.
The purchaser later defaulted, and High Court proceedings followed. The agreement was challenged. Every clause, every obligation, every consequence, and every legal safeguard had to stand up under scrutiny.
Today, the Court granted an order confirming the validity of the agreement and directing the eviction of the purchaser, who was found to have no lawful basis to remain in occupation of the property.
This was a deeply meaningful moment for me.
After more than two decades in the legal industry, including over a decade in private practice, this was the first time one of my property agreements had to be tested in court at this level. I am grateful to say: it held.
That is what proper legal drafting is supposed to do.
In property transactions, a defective agreement is not a small administrative problem. It can become a costly legal battle, a delayed transfer, a failed transaction, or years of unnecessary stress.
A sincere thank you must also go to Chris Salmon Attorneys, who represented the client on the litigation side. As the conveyancer involved in the transaction, AMS Attorneys Inc could not litigate against either party to the agreement, and it was therefore essential that the client had strong litigation representation to carry the matter through court.
At AMS Attorneys Inc, we do not believe in flashy promises. We believe in sound law, strategic drafting, practical protection, and standing by our clients when the matter is simple — and when it becomes difficult.
Because when things go wrong, you do not need marketing gimmicks.
You need an attorney in your corner.
