WHAT IS THE RENTAL HOUSING TRIBUNAL

If you are a tenant you should know that the Rental Housing Tribunal can issue judgments without going to court.

It's a legal body appointed to handle disputes between landlords and tenants (only residential properties) through mediation and arbitration.

MATTERS THAT THE RENTAL HOUSING TRIBUNAL DEAL WITH;

-failure to refund a deposit
- failure to adequately maintain the rental property
- unlawful seizure of a tenants property
-illegal changing of locks
-illegal disconnection of electricity and water
-exploitative rentals
- unlawful notices to vacate
- unilateral changes to lease agreement

Only an order from the courts can legally evict a tenant. The Rental Housing tribunal requires all lease agreements to be in writing.

The idea of the Rental Housing Tribunal is to handle issues quicker than the courts however due to covid matters seem to be taking longer to finalize.

Matters taken to the Rental Housing Tribunal are free and don't require an Attorney.

What does Voetsoots mean???

What you see is what you get and there is no warranties. Sellers are not allowed to lie to buyers or fail to tell them about defects.

A Voetsoots clause doesn't protect the seller against claims for defects that the seller knew and deliberately hid or didn't disclose to the buyer. Even if the buyer didn't know about some of the defects there is an implied warranty and they will still be liable.

What can you do if the seller has deliberately failed to disclose defects??

- have the supplier fix/repair the defects or claim a refund
- you can fix the goods and claim for a refund.

Since January 2020, fathers are entitled to paternity leave of 10 consecutive days( which is inclusive of weekends). This is unpaid leave and can be claimed from UIF.

- UIF claim will only be up to 66% of your earnings ( subject to the maximum income threshold in the Unemployment Insurance Act)

Can whatsapp messages constitute a binding agreement??

For a contract to be formed there must be an offer and acceptance between parties. There are certain requirements that must be met for the contract to be legally binding on the parties involved.

As such, a whatsapp message can be construed as a valid agreement if the relevant requirements for the creation of a contract have been met.

- a valid offer and acceptance ( the party making the offer must intend on being bound by the offer once its accepted)

-consensus between parties ( when a party accepts the offer then they both have consensus to be bound by the agreement. Acceptance can be express acceptance {writing /verbal} or by conduct of the party).

-capacity to contract( both parties must have the requisite legal capacity to contract).

If an agreement that is lawful is created by the fulfillment of the above requirements and the obligations are able to be performed, then the agreement is legally binding.

What constitutes defamation when it comes to social media????

Defamation can be a statement or post published on social media that can be seen as derogatory and it damages another person's good name or reputation.

Legally - to take action against someone for defamation, you have to prove the following ;
1. The content must have been published and seen by atleast one person other than the person who says they have been defamed;
2. The content must be defamatory ( eg disagreeing with someone online is not defamation, however calling someone something insulting because you disagree with them could be).
