Should you claim from the Road Accident Fund (RAF) without an attorney?
It is very interesting how the RAF is trying very hard to get people to claim directly from them without an attorney. The RAF is looking after their own interests and therefore cannot fully look after your interests. You need an attorney to look after your interests.
If you claim directly you might get paid only R200 000 yet with an attorney you could get a few million for the same claim. The reason for this is because claims are complicated and without all the proper doctors, specialist and expert reports you cannot justify your claim and the RAF will pay you only what you have proved i.e. R200 000.

On the other hand, attorneys who specialise in such claims and know what they are doing can prove to the RAF (or to the Court, if the RAF refuses to pay) that you deserve to be paid a few million. We cover the costs of all the medical experts and other experts.

You may save legal costs by claiming on your own but you will get paid very little. With an attorney you will have to pay legal costs but you end up with much more. Do you prefer getting the R200 000 with no legal costs or do you prefer R2million with R250 000 legal costs?

If u have an old unpaid account PLEASE READ!!! A friend of mine was contacted by an "agent" about a loan that she took about 4 years ago but never paid it as she lost her job. The agent told her the law (Consumer Protection Act) now provides for ppl to sign a document that allows them grace until they find employment. After investigations I discovered that this agent had bought bad debts from the loan company and is conning ppl to sign an acknowledgment of debt, consent to judgment and emoluments attachment order. If 3 years have passed since you last paid or signed anything the debt has most probably prescribed (expired) and they cannot claim it from you. (***N.B. This does not apply to all accounts - certain conditions have to fulfilled). If you sign this document or make a payment your protection of prescription falls away and the debt can be claimed from you. BE CAREFUL & DON'T SIGN UNLESS YOU KNOW WHAT YOU ARE SIGNING! ! ! !
