𝗪𝗛𝗔𝗧 𝗜𝗦 𝗖𝗔𝗣𝗜𝗧𝗔𝗟 𝗚𝗔𝗜𝗡𝗦 𝗧𝗔𝗫?

Capital Gains Tax (CGT) in South Africa is a tax you may need to pay when you dispose of an asset - such as property, shares, or even a valuable item - for more than you originally paid for it. This tax has been in effect since 1 October 2001 and is governed by the Eighth Schedule of the Income Tax Act (No. 58 of 1962). A "disposal" doesn't only mean selling an asset; it also includes donation, alienation, or death (deemed disposal).

To 𝗰𝗮𝗹𝗰𝘂𝗹𝗮𝘁𝗲 𝗖𝗚𝗧: (Capital Gain – Exclusions) × Inclusion Rate × Marginal Tax Rate.

Firstly, calculate the capital gain, which is the difference between the sale price and the original purchase price (known as the base cost). Then you deduct any exclusions - individuals get an ‘annual’ exclusion of R40,000. The inclusion rate determines how much of the remaining gain is taxable: 40% for individuals and 80% for companies and trusts. Finally, the taxable amount is added to your annual income.

𝗙𝗼𝗿 𝗲𝘅𝗮𝗺𝗽𝗹𝗲, if an individual sells a piece of land for R300,000 of which the base cost was R100,000, the capital gain is R200,000. After applying the R40,000 annual exclusion, R160,000 remains. At an inclusion rate of 40%, only R64,000 is subject to tax. If the person earned R300 000 in the tax year, the gain of R64 000 is added to the R300 000 and income tax is payable for that tax year on R364 000.00 at the marginal rate applicable to the tax bracket the person falls into, which in this example will be R42 678 + 26% of taxable income above R237 100. Effectively the person will be liable for R16 640.00 capital gains tax for the year on top of the normal income tax (R64 000 x 26%).

𝗦𝗔𝗥𝗦 𝗽𝗿𝗼𝗵𝗶𝗯𝗶𝘁𝘀 𝗮 𝗽𝗲𝗿𝘀𝗼𝗻 𝘁𝗼 𝗴𝗶𝘃𝗲 𝘀𝗽𝗲𝗰𝗶𝗮𝗹𝗶𝘇𝗲𝗱 𝘁𝗮𝘅 𝗮𝗱𝘃𝗶𝗰𝗲 𝗶𝗳 𝘀𝘂𝗰𝗵 𝗽𝗲𝗿𝘀𝗼𝗻 𝗶𝘀 𝗻𝗼𝘁 𝗮 𝗾𝘂𝗮𝗹𝗶𝗳𝗶𝗲𝗱 𝗮𝗻𝗱 𝗿𝗲𝗴𝗶𝘀𝘁𝗲𝗿𝗲𝗱 𝘁𝗮𝘅 𝗽𝗿𝗮𝗰𝘁𝗶𝘁𝗶𝗼𝗻𝗲𝗿. 𝗙𝗼𝗿 𝗲𝘅𝗽𝗲𝗿𝘁 𝗮𝗻𝗱 𝗽𝗲𝗿𝘀𝗼𝗻𝗮𝗹𝗶𝘀𝗲𝗱 𝗮𝗱𝘃𝗶𝗰𝗲, 𝗶𝘁 𝗶𝘀 𝘀𝘁𝗿𝗼𝗻𝗴𝗹𝘆 𝗮𝗱𝘃𝗶𝘀𝗲𝗱 𝘁𝗵𝗮𝘁 𝘆𝗼𝘂 𝗰𝗼𝗻𝘀𝘂𝗹𝘁 𝘄𝗶𝘁𝗵 𝗮 𝗾𝘂𝗮𝗹𝗶𝗳𝗶𝗲𝗱 𝘁𝗮𝘅 𝗽𝗿𝗼𝗳𝗲𝘀𝘀𝗶𝗼𝗻𝗮𝗹.
