Most fixed-term employees only realise this when it is too late:

Your contract ending does not always mean your rights end.

We often see this situation. You have been on a fixed-term contract for months. Sometimes it has been renewed before and the work continues as normal.

Then suddenly, it is not renewed, no discussion, no process.

That is where the law becomes important.

Under the Labour Relations Act, fixed-term employees may still be protected:
– After 3 months: equal treatment
– Repeated renewals: may create a reasonable expectation of renewal
– Non-renewal: may be a dismissal in certain cases
– After 24 months: severance may apply

The problem is that many people rely only on what their contract says. Not what the law provides.

And they are not always the same thing.

Suffering in silence at work and then resigning is not the end of the road. For a lot of South Africans, it is actually the beginning of a legal case they did not know they had.

If your employer demoted you unfairly, bullied you, cut your salary without cause, or made coming to work genuinely unbearable, the Labour Relations Act may still be on your side even after you have already left.
