🔎 What did SARS rely on to refuse suspension of payment? The taxpayer wanted the records.

In Devland Cash and Carry v CSARS, the taxpayer sought more than SARS’s reasons. It demanded the material behind the decision — committee minutes, internal recommendations, risk analyses and evidence supporting allegations about its business and assets 📂⚖️

Why does this matter? Those records could reveal whether SARS’s refusal to suspend payment was lawful, reasonable and rational.

📽️ In this training clip, Nico Theron unpacks what the taxpayer demanded.

💰 No cash changes hands — could a trust distribution still have tax consequences? 👀

A South African trust distributes a loan claim to a foreign trust. SARS treats it as a donation, settlement or other disposition for purposes of section 7(8) — raising questions about who may be taxed on the resulting income🌍⚖️

In this clip from our BPR 430 training, Nico Theron explains why the attribution rules deserve closer attention🔎

+\-R3m VAT saving acheived. Import VAT disallowed by . Had to threaten with legal action twice: once to get SARS to pay back money they incorrectly took out of the taxpayers bank account and then again to keep them to the objection time periods. The merits were also interesting in that it was quite old claims being put in now and accounting records were not ideal so the evidence pack was crucial.

In complex disputes, understanding how SARS views a specific set of facts can be the difference between exposure ⚠️ and a well-defended position 🛡️.

That’s why breaking down and contextualizing newly released tax interpretation laws and rulings in a clear, accessible way isn’t optional — it’s strategic ♟️.

⚖️ A R3.59 MILLION SARS exposure.
💰️ A R3.32 MILLION saving.

When the numbers are this significant, how you approach the dispute matters.

Our client faced R3,594,419.66 in tax exposure relating to penalties and interest. Through strategic objection, remission requests, procedural intervention and persistent engagement with SARS, the position changed substantially📑⚖️

The outcome speaks for itself:
🔴 Tax exposure: R3,594,419.66
🔵 Final tax liability: R270,235.86
🏆 Total saving: R3,324,183.80

This is why specialist intervention matters in complex, high-exposure tax disputes🧩
It is not only about challenging SARS — it is about knowing what to challenge, how to challenge it, and which procedural steps to take when the matter does not move as it should♟️
