Clear workplace rules create a stronger business.

Employers have the right and responsibility to implement reasonable workplace rules and maintain discipline. Clear employment contracts, policies, procedures and an up-to-date disciplinary code help prevent misunderstandings, promote productivity and create a positive working environment.

When misconduct occurs, employers must follow the correct process. Discipline should aim to correct behaviour, while dismissal should remain a last resort and must always be supported by a fair reason and fair procedure.

A small procedural mistake can have serious financial consequences for an employer. Address workplace issues early and obtain expert labour law advice before they escalate.

Conducting successful disciplinary hearings require meticulous adherence to both procedural and substantive fairness. Employers cannot dismiss an employee without first holding a procedurally fair hearing and ensuring that a fair reason exists for dismissal, as this ensures compliance with legislation and limits risks when dealing with disputes at bodies like the Commission for Conciliation, Mediation and Arbitration (CCMA).
