After a family member passes away, the heirs may decide together that selling the family home makes the most sense.

They find an interested buyer, agree on a price and prepare to sign the offer to purchase.

There is an important legal consideration at this stage: who has the authority to sell property belonging to a deceased estate?

In South Africa, the administration of a deceased estate is governed by the Administration of Estates Act. The executor or another properly authorised estate representative deals with estate assets under the applicable legal process.

The will, the executor's appointment and the requirements involving the Master of the High Court can all affect how the sale proceeds.

For families considering the sale of inherited property, establishing who may act on behalf of the estate is an important starting point.

Your dog has always been friendly. It loves visitors and has never shown signs of aggression.

One afternoon, someone leaves the gate open. Your dog wanders out and bites a person walking past your property.

The injured person wants compensation.

Under South African law, a dog owner may be held liable for injuries caused by their animal through a legal remedy known as the actio de pauperie.

What makes this particularly interesting is that liability under this remedy can arise even where the owner was unaware that the dog might behave aggressively.

The circumstances of the incident remain important, including whether the animal acted contrary to its nature and whether any recognised legal defences apply.

Would you expect the owner to be responsible even if the dog had never bitten anyone before?

You ordered a new laptop.

The tracking notification says it has been delivered, but when you get home there is nothing waiting for you. After making a few enquiries, you discover the courier delivered it to the wrong address.

Who do you contact first?
🟢 The seller
🔵 The courier company
đźź  The neighbour

For most consumer purchases, your first point of contact should be the seller. Under the Consumer Protection Act, goods generally remain at the supplier's risk until the consumer has accepted delivery. If a parcel is delivered to the wrong address without your authority, the supplier cannot simply shift responsibility to the courier. The specific circumstances of each matter remain important, including the delivery instructions and the terms of the transaction.

An engagement ends and, among all the emotional conversations that follow, somebody asks for the ring back.
Who gets to keep it?

An engagement ring is usually given in contemplation of marriage, which can become relevant when determining what happens to it after an engagement ends. The circumstances surrounding the gift and the termination of the engagement can also matter.

Then consider a ring that has been in one family for three generations.

Its sentimental significance may make the dispute considerably more personal, while the legal question still requires attention to the circumstances in which it was given.

It is one of those everyday situations where something deeply personal can suddenly raise questions about ownership and the law of gifts.

Before reading anyone else's answer, what would your instinct be: the giver or the recipient?

Writing someone out of a will may be more complicated than it sounds

A will gives you considerable freedom to decide how your estate should be distributed.

South African succession law also operates alongside legislation protecting certain interests after death.

Under the Maintenance of Surviving Spouses Act, a surviving spouse may have a claim against the deceased estate for reasonable maintenance where adequate provision has not been made, subject to the requirements and circumstances contemplated by the legislation.

This means estate planning involves more than deciding who receives which asset. Existing legal obligations and potential claims against the estate also form part of the picture.

When a project falls behind, frustration can move faster than the contract allows.

Deadlines have passed. Work remains unfinished. Costs are mounting.

For an employer dealing with an underperforming contractor, ending the relationship may seem like the obvious next move.

The construction agreement may prescribe the grounds for termination, the notice that must be given and any opportunity the contractor has to remedy a specified default. Common-law rights may also become relevant depending on the circumstances.

The termination process therefore deserves the same attention as the decision to terminate.

A step taken too quickly can create further contractual consequences and potential exposure to a damages claim.

Before instructing a contractor to leave a site, start with the termination provisions in the agreement.

You've probably seen "domicilium citandi et executandi" buried somewhere in a lease, credit agreement or commercial contract.

In practical terms, it refers to an address chosen for the service or delivery of legal notices and documents.

That becomes particularly important when your circumstances change.

If you move house or relocate your business while the agreement continues, look at the domicilium clause. The contract may contain a specific process for changing the chosen address.

Keeping those details current can help ensure that important contractual or legal communications reach the correct place.

So here's a small contract check worth doing today:
Do the long-term agreements you currently have still contain your correct address?

You resign on Friday and on Monday, you're joining the competition.

Then your former employer points to the restraint of trade in your employment contract.
Can they actually enforce it?

In South Africa, signing a restraint matters. Whether it will ultimately be enforced depends on the circumstances, including the interest the employer seeks to protect and whether enforcement would be reasonable.

Confidential information and established customer connections can qualify for protection. Preventing ordinary competition, on its own, stands on different ground.

That means the real question reaches further than, "Did I sign a restraint?"
It becomes: what is the employer protecting, and how far does the restraint go?

Some of the most valuable things we inherit will never appear in a will.

A recipe remembered by heart. A family story told so many times that everyone knows the ending. A language spoken between generations. A song, a craft, a tradition or a way of doing something that came from those before us.

Heritage takes many forms.

South Africa celebrates Heritage Day as an opportunity to recognise the cultural heritage of the many communities that make up our country.
For us, it also offers an interesting thought about inheritance.

Alongside the homes, possessions and documents that move between generations are things whose value cannot be measured on an inventory.

If you could preserve one part of your family's heritage for another 100 years, what would you choose?

Happy Heritage Day from Meyer & Partners Attorneys.

Imagine negotiating a five-year lease.
Everyone agrees. The document is prepared. Both parties sign.

Later, someone discovers that the written contract records the term as fifteen years.

South African contract law provides a remedy known as rectification in certain circumstances where a written document fails to record the parties' true common intention because of a mistake.

That common intention matters. Where both parties genuinely agreed to five years and the document mistakenly records fifteen, rectification may be available if the necessary requirements can be established.

Where the parties actually had different understandings of what they were agreeing to, the legal issue changes considerably.

This is also a useful reminder to read the final document against what was actually negotiated before signing.
