Schools can conduct random searches and drug testing – but only within clear legal limits. A search must be based on fair and reasonable suspicion and carried out in a manner that respects the learner’s privacy and dignity. Body searches require same-gender officials, a private setting, and an adult witness. Any seized items must be documented and handed to the police, and parents must be notified promptly. Learners may face disciplinary action if prohibited items are found or tests are positive.

The boundaries of school discipline are no longer confined to the classroom. In South Africa, schools may take action against learners for off-campus misconduct – including social media behaviour – if it affects the school’s interests, reputation, or learning environment. The key question is whether there is a clear nexus between the conduct and the school. Does it disrupt discipline, threaten safety, or harm other learners? If so, school disciplinary measures may be appropriate. But there are safeguards: schools must act within their Code of Conduct, comply with the South African Schools Act, and uphold learners’ constitutional rights, including fairness and dignity. Ultimately, discipline must balance school authority with the rights of the child.
