What does this mean for asylum applicants?

⚖️ The Constitutional Court judgment of 7 July 2026 remains legally binding.

📄 The reported withdrawal concerns the operational directive, not the Constitutional Court judgment itself.

⚠️ Applicants should confirm the latest procedures before attending Refugee Reception Offices.

📢 We are awaiting formal confirmation of the withdrawal and any revised instructions from the Department of Home Affairs.

🚨 IMPORTANT SOUTH AFRICAN IMMIGRATION UPDATE! 🇿🇦

GOOD NEWS FOR FOREIGN NATIONALS APPLYING FOR VISA EXTENSIONS OR CHANGES OF STATUS!

The Minister of Home Affairs has issued Immigration Directive No. 13 of 2026, introducing a blanket waiver of the requirement to submit certain visa applications at least 60 days before the expiry of an existing visa.

✅ WHAT DOES THIS MEAN?

✔️ Applicants are no longer required to submit applicable visa extension or change-of-status applications at least 60 days before visa expiry.

✔️ The waiver also covers qualifying applications and appeals already pending adjudication.

✔️ Future qualifying applications are included.

⚠️ IMPORTANT CONDITION

Your application MUST still be submitted BEFORE your current visa expires.

This directive does NOT mean that you can apply after your visa has expired.

🇿🇦 Can You Work in South Africa With a Waiver?

A common misunderstanding is that once a waiver has been approved, a person may automatically start working in South Africa.

This is not the case.

A waiver simply relaxes or removes a specific visa requirement. It is not a work visa and does not, on its own, give a foreign national the right to work.

A person may only work if their current visa or immigration status specifically allows employment.

✅ Waiver approved + correct work visa issued = you may work
❌ Waiver only = you may not automatically work

It is important to understand your visa conditions before accepting employment or starting work, as working without the correct authorisation can create immigration complications.
