"How long will this take?"

Every client asks it. We will not answer it with a number.

Not because litigation is a mystery — because we would not control the answer. The court's roll is the court's. The other side's tactics are theirs. Witnesses and experts move at their own pace.

An estimate we cannot enforce is worth nothing to you on the day it is missed. Worse, it becomes a second grievance on top of the one you came in with.

Working from an estate checklist that says R125,000?

It is wrong — and it has been wrong since 2014.

Where a deceased estate falls under a set value, the Master of the High Court can take a lighter route: no letters of executorship, directions instead, and usually a Master's Representative rather than an executor.

That value is R250,000. It was raised from R125,000 by GNR 920, published in Government Gazette 38238 on 24 November 2014, and it applies where the death occurred on or after that date. More than a decade later, checklists quoting the old figure are still doing the rounds — including some official ones.

If you are reporting an estate, check the figure you are working from. If it says R125,000, it is out of date.

Ours says R250,000. It is the checklist we give our own clients, it is on our website, and there is nothing to fill in.

No. Self-help evictions are unlawful in South Africa. Taking matters into your own hands — even when the tenant is clearly in the wrong — can result in legal consequences for the landlord.
The only lawful route is through the courts. It takes time, but it protects your position.

Getting married without signing an antenuptial contract? You'll be married in community of property by default — sharing all assets and all debts from day one. That includes your spouse's business debts.

An ANC should ideally be signed before the wedding. It can be done afterwards, but the process is more complex and costly. Every couple's situation is different.
