Our trust clients will be aware from our recent mailers that trustees must now file beneficial ownership registers with the Master, and keep these details updated. They must also file prescribed trust documents with SARS when submitting their trust tax returns. With SA's grey listing, trusts have attracted scrutiny and additional compliance burdens, and this does sadly increase the legal and accounting costs associated with trusts.

Trustees are increasingly considering risk-based fee structures.

We cannot over-emphasise the importance of a well-crafted, bespoke will, prepared with you, your values, your specific family set-up and your specific financial circumstances in mind. While it is tempting to delay making a will, your loved ones ultimately pay the price for failure to plan ahead.

We check-in annually with our clients on their wills, to ensure that the document keeps step with their unfolding lives and circumstances. We strongly encourage our clients to thoroughly review their wills with us at least every five years, so that incremental changes to family or financial circumstances or the legal or regulatory landscape do not diminish the effectiveness of their will.

Many South Africans will have noticed dropping service levels in the banking sector, with fewer branches and tellers and longer queues for in-branch services. This has had a negative impact on the winding up of deceased estates, as this work is left to under-staffed departments burdened with highly bureaucratic procedures. It can take months before a deceased person's own bank account can be accessed by their executor.

I was happy to be part of a recent Fiduciary Institute of South Africa meeting with Absa Bank to gain greater insight into that bank's in-house procedures, and give input as to "design fails" that were negatively impacting clients.
