Expungement of your criminal record means the removal of certain criminal convictions from the national criminal record.

So who qualifies???
1. At least 10 years since conviction.
2. No further convictions with jail time (without option of a fine) in that 10-year period.
3. Sentence must have been relatively minor (fine under R20,000, suspended sentence, correctional supervision, etc.).
4. Not for serious/sexual offences (esp. against children/mentally disabled persons).

For ordinary drivers, the law allows a very small margin: no more than 0.05 grams of alcohol in 100 millilitres of blood, or 0.24 milligrams per 1 000 millilitres of breath. For professional drivers, the rope is even shorter.. only 0.02 g/100 ml blood or 0.10 mg/1000 ml breath. Go above that, and you’ve crossed the legal line. 🥃🍷🍻

If the device shows you’re over, or you refuse to blow, the officer can take you in. At the station or hospital, a blood test follows and it must be done within two hours. You cannot legally refuse this test. From that moment, you’re not just a driver anymore; you’re an accused person with a police docket in your name.

You’ll likely spend the night in a cell, unless bail is granted quickly. By law, you must be brought before court within 48 hours (excluding weekends and public holidays).

And what then? If convicted, the consequences cut deep. You face fines, or worse, imprisonment of up to six years. Your driver’s licence is suspended automatically. Either for six months for a first offence, five years if it’s your second, and ten years if you keep repeating the mistake. Along with that comes a criminal record, the kind that follows you into job interviews, visa applications, and every background check.

The law is also clear that you don’t have to be over the technical limit to be guilty. If your driving shows you were impaired and you are either weaving, reckless or unable to control your car, the court can still convict you. And it’s not only alcohol; drugs count too.

There’s talk of a future where South Africa adopts zero tolerance, where any trace of alcohol in your system will put you on the wrong side of the law. But for now, the limits above remain.
