Not all dismissals work the same way.

Most employees are entitled to notice when their employment ends. But South African law recognises a category of conduct so serious that it justifies ending the relationship immediately — no notice, no payment in lieu.

This is called summary dismissal. It is reserved for gross misconduct that fundamentally undermines the employment relationship.

But here is what many employers miss: summary dismissal does not mean the disciplinary process can be skipped. Employers who assume otherwise face significant legal exposure at the CCMA and Labour Court.
