🔍 What is a Section 14 Notice to Remedy a Breach?

A Section 14 Notice is a formal written notice issued under the Consumer Protection Act that tells a party (either tenant or landlord) they've breached the lease agreement – and gives them a chance to remedy the issue.

✅ Who can issue it?

Landlords can serve it if a tenant breaches the agreement (e.g., rent arrears, property damage).

Tenants can serve it if a landlord breaches their obligations (e.g., failing to carry out repairs).

📅 When does it apply?
It applies when:

There's a breach of the lease agreement.

The breach can be remedied.

The party serving the notice wants the issue resolved without ending the lease agreement—yet.

⏳ The notice gives the other party 20 business days notice to remedy the breach.

⚠️ If the breach isn’t remedied within 20 business days, the next step may be applying to the tribunal for further action—including termination of the lease.

Evicting a tenant isn't as simple as just asking them to leave. In South Africa, the eviction process must follow strict legal procedures under the PIE Act to protect both landlords and tenants.

🔍 Here’s a step-by-step outline of the legal eviction process:

1️⃣ Grounds for Eviction
➤ Breach of lease (non-payment, damage, etc.)
➤ Lease expiry and refusal to vacate
➤ Illegal occupation

2️⃣ Notice to Remedy the Breach
➤ Tenant gets 20 business days notice (in writing) to fix the issue (e.g. pay overdue rent).

3️⃣ Lease Cancellation
➤ If not remedied, a written notice of cancellation is issued.

4️⃣ Notice to Vacate
➤ Tenant is given a full calendar months notice to vacate, in writing.

5️⃣ Court Application for Eviction Order
➤ File through an attorney
➤ Provide legal grounds and documentation
➤ Attend court hearing
