Good day all

Many individuals are getting married without understanding the consequences of their marital regime. South Africas default marital regime is in community of property meaning yourself and your new spouse estate is seen as one. The divorce rate in South Africa is quite high and many individuals come to regret not entering into an Antenuptial Contract (ANC) or popularly known as a prenup why because upon divorce legal fees can be astronomical as the couple who once we're so in love can't come to a compromise due to one or both spouses greed or one spouse passes away and then the surviving spouse just jumps into another marriage and unfortunately many children of the surviving parent come to realize what huge mistake their parent made especially when such parent had a number of assets upon remarriage, due to our law granting the surviving spouse many rights which could mean your step parent depending on the size of the joint estate could inherit the bulk if not the entire estate if there is no will in place.

Our office are frequently dealing with such matters as the children would argue that their step parent did not work for that house or assets how can they inherit it or become part owners of it however unfortunately what's morally correct and what's legally correct is vastly different and the law of the land prevails.

Therefore if you lost your spouse or you as the child knows your surviving parent wants to remarry or you as an individual(s) are thinking about getting married for the first time rather consult an attorney for advice and thereafter if necessary have them draw up an antenuptial contract for you it may cost a sum of money which may seem like much now but it could save you or your children much much more in years to come.

Our office have come across a vast number of people who believe that a legal transaction took place via the magical police affidavit.

client:I transferred this house into my name paid the seller x amount of money I was told you don't need a lawyer just go to the police station do an affidavit and property is yours seller gives the purchaser possession of the property and then for years the purchaser believes it's his property until he gets a letter to say he must move out or seller passed away now sellers children saying get out, purchaser only then finds out after consulting an attorney that he is not the owner.

Fact you always need a transferring attorney to get a house in your name.

Client:I Wana get divorced I'm married out of community of property
attorney: ok no problem where's the antenuptial contract?
Client:whats that
Attorney: document showing you married out of community of property
Client: oh here it is I did it at the police station police commissioned it.
Attorney: no this affidavit is not valid
Client: but police and someone else told me that this is all I need to be married out of community of property
Attorney: unfortunately you married in community of property

Fact: you need an attorney to help you with an antenuptial contract to be married out of community of property

The problem which baffles and frustrates many attorneys is that there is such a lot of misinformation out there which can have huge financial repercussions for those who follow this information and the magical police affidavit though many times legally required is not the solution for all legal problems and transactions therefore do not underestimate proper legal advice a small consultation fee with an attorney could save you money.

As a firm who notarizes many documents we more often than not notarize antenuptial contracts for parties wishing to get married and therefore it's a decision you need to make with your partner before entering into a marriage as you need to fully understand the consequences of each marital regime as the default marital regime of South Africa is in community of property which means 50/50 assets and liabilities so your assets and liabilities become your spouses and vise visa so consult an attorney or notary public before getting married and thereafter you and your partner will be in a position to make an informed decision.
It's important to note the above information is merely scratching the surface and is in no way a substitute for proper legal advice from an attorney or Notary public.

As a private legal practice that specializes in property transfers and deceased estates we love assisting and have assisted and finalized many deceased estates for the public in this regard. Having said that deceased estates can get very complex especially when the deceased died many years ago sometimes decades ago or heirs just did not finalize the deceased estate based on affordability or ignorance of the legal position. What we often find is either heirs cannot agree on what is to happen with the assets especially when there is no will in place and some heirs even do things behind other heirs back to profit illegally from the estate. Always have a will in place so that your heirs know how your estate should be distributed and even there is no will do not wait many years to finalize the deceased estate because as mentioned before it can get very complex and expensive which many heirs unfortunately cannot afford. If you cannot afford a private attorney then rather apply to legal aid or the LPC to provide assistance however these institutions are extremely busy and it could take years for them to assist you and in many cases do not assist with complex estates.
Another major problem is people getting incorrect advice from family and friends regarding what should happen in the estate and sadly many individuals get conned or run around to different institutions based on this incorrect advice as they went for a cheaper alternative which we found in many cases was to there detriment.

Always seek proper legal advice and if an estate is worth more than R250 000 you will be directed by the Master to seek the assistance of an attorney and remember just because one estate took a certain amount of time doesn't mean another estate will be the same each estate is different one estate can take one year to finalize another can take 2 years or even as little as a few months so do not compare past experience with an estate and assume this is how long it should or will take as there are various reasons for delays fortunately most clients understand this as they have past experience or know someone who went through this process or just have faith and trust that our office will get it done even the complex estates.

THE IMPORTANCE OF A CONSULTATION

Today I would like to announce the importance of a consultation with an attorney.
As one of the very few law firms on the Cape Flats, it astounds me all the misinformation being given by unqualified individuals which many a times leads to the person running around to various entities only to discover after consulting an attorney that it was all unnecessary and often too late for the attorney to do anything.
Always consult a legal professional where more often than not a consultation fee will be applicable alternatively if you cannot afford the consultation fee, make enquiries at the various legal clinics or legal aid etc but do not seek legal advice from unqualified individuals because it could have long tern financial consequences if you unsure about the individuals qualifications, go to the LPC website for practicing and non-practicing attorneys.
