We know immigration is a hot topic đź‘€

And we totally get your frustration.

Cape Town can be expensive and digital nomad policies should be handled responsibly so that locals aren’t pushed out of their city.

But here’s the thing. Immigration goes way beyond digital nomads.

There are African nationals facing serious immigration challenges.

People who need information on spousal visas so that they can be reunited with their loved ones.

Some need to know about business visas so that they can start a business here or invest in a South African company.

If you read the feature you’ll see that it unpacks various types of visas.

If you have any questions about immigration and the options that are available to you, comment below and Kristina Dolischka (Gromova) from De Jure Immigration will answer them 👇

New Update: for Foreign Nationals in South Africa awaiting outcome to pending applications:

The Department of Home Affairs has issued Immigration Directive No. 4 of 2025, extending temporary concessions for foreign nationals affected by delays in the processing of visa appeals, waivers, and long term applications.

Extension until 30 September 2025 for awaiting outcomes on:

1) Waiver applications
2) Long-term visa applications
3) Appeals on rejected long-term visa applications

Travel permitted during this period without being declared undesirable, provided specific documentation is presented.

Non-visa exempt nationals must still apply for a port of entry visa if they travel with a pending application.

Applicants for permanent residence must ensure they maintain valid temporary residence, as this concession does not apply to PR applications.

The process of applying for a visa itself can be complex and riddled with potential pitfalls.
From choosing the right application to filling it out correctly, there are countless opportunities to make mistakes. Even small errors, like listing incorrect dates or forgetting to include supporting documents, can result in rejections or delays. And let’s not forget the financial burden of refiling or appealing.

At De Jure Immigration, we help clients to avoid these pitfalls every day.

All foreign nationals who are awaiting outcomes to waiver applications can remain in South Africa whilst awaiting outcomes to such applications. In addition, they can depart South Africa on the basis of the original VFS Global receipt on or by no later than 31 March 2025. Applicants awaiting outcomes to waiver applications are only allowed to conduct the activities as authorized by the visas which they held at the time of application.

All foreign nationals who are awaiting outcomes to their long-term visa applications and those awaiting outcomes to temporary residence appeals can also travel on or by no later than 31 March 2025 provided they produce the original VFS Global receipt confirming the submission of an application. The foreign nationals are allowed to continue conducting the activities as authorized by the visas they held at the time of submitting their visa applications.

For those foreigners who collected negative outcomes but were unable to file their appeals timeously because of VFS Global’s inability to cope with the high numbers of applicants, they can show the Rejection Notice and confirmation that an appointment has been secured for any date on or before 31 March 2025 for the submission of the appeal and they can depart without being declared undesirable.

Tourists who entered the country on 90-day visitor visas from 1 October 2024 and have applied for the extension of their visitor visas must ensure that they depart South Africa within 180 days. This means that even if the application for the visitor visa extension remains pending with the Department, foreigners who entered the country as tourists must ensure that they depart South Africa within 180 days and show the original VFS Global receipt. The concession, as per all the previous ones granted by the Department, only apply to those foreigners who have been entered into the country legally.
