Do electronic signatures have a place in conveyancing?

Technology is steadily moving transactions away from paper and wet-ink signatures towards digital documents and electronic signing. Yet many processes in the South African legal profession remain firmly paper based. Is this merely “old-school” practice, or is there sound reason for it? This article considers why wet-ink signatures are still required for the alienation of land, and whether that position remains appropriate in the conveyancing world of 2026.

In the recent case of De Bruyn v Master of the High Court, Pretoria and Others (1338/2024) [2026] ZASCA 92 involving a deceased estate, the Supreme Court of Appeal gave preference to the claim of a surviving spouse to the exclusion of the deceased’s heirs. The case reaffirmed the strong legal entitlement of a surviving spouse under the Maintenance of Surviving Spouses Act 27 of 1990.

The meaning of “home” is central to the protection against unlawful eviction under the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998. The term is not defined in PIE and may extend beyond conventional residential property. This raises an important question: can university accommodation—or even other university property occupied as shelter—become a student’s home?

The concept of what would be considered a ‘home’ in its nature is complex to interpret, it has a wide meaning and to an extent creates injustices such as unlawful evictions as its place under the Prevention of Illegal Eviction and Unlawful Occupation of Land Act 19 of 1998 remains protracted. This leaves people’s livelihoods compromised and their constitutional right to adequate housing infringed. But does this apply to students who live in university residences?
