SL Law is pleased to have acted for the successful applicant in the reportable judgment handed down yesterday by the Western Cape High Court in Shifa Picton Apartments (Pty) Ltd v Beachmaster Investments 700 (Pty) Ltd & 2 Others (Case No. 2026-066186).

The judgment addresses an important and developing area of South African contract and property law: can a digitised wet-ink signature satisfy the signature requirement in section 2(1) of the Alienation of Land Act 68 of 1981?

The Court held that it can, on the facts before it.
Importantly, the Court did not find that ECTA validates an electronic signature for purposes of the Alienation of Land Act. It accepted that ECTA cannot be invoked as the source of compliance with section 2(1).
The important distinction lies elsewhere.

The judgment confirms and develops the approach in Borcherds v Duxbury and provides welcome guidance on the distinction between an electronic signature and a digitised manuscript signature. Stefan le Roux and Celine Bakker of the SL Law litigation team acted for Shiffa.
