BEYOND THE BRIEF | A Day in Litigation with Kevin Short

What does a typical day in litigation actually look like?

For Kevin Short, it starts with an early run or a good cup of coffee, followed by client consultations, strategy sessions with counsel, drafting, negotiations and preparing for hearings.

But there's much more to litigation than what happens in the courtroom.

In this edition of Beyond the Brief, Kevin shares a glimpse into the work that happens behind the scenes, his approach to resolving disputes, and why he believes good litigation is about more than simply securing a favourable judgment.

It's about understanding the risks, considering the alternatives and finding commercially sensible solutions for clients.

And when the legal battles are over? You'll likely find him outdoors, fly rod or camera in hand.

Meet Kevin beyond the brief.

Everything today is instant.

Emails are sent in seconds. Deals are agreed over WhatsApp. Documents are signed electronically with a single click.

But contracts deserve more than a quick glance.

Every business owner has experienced the pressure to sign an agreement quickly so operations can move forward. It may seem straightforward, and obtaining legal advice can feel like an unnecessary delay or an additional expense.

The reality is that a contract doesn't simply record an agreement. It defines your rights, your obligations and what happens if things don't go according to plan.

A clause that's overlooked today could result in:
• Costly disputes
• Unexpected financial obligations
• Restrictions on terminating the agreement
• Expensive litigation
• Damage to your business relationships and reputation

The cost of reviewing a contract before signing is almost always significantly less than the cost of trying to correct a problem after you've become legally bound.

At EY Stuart Attorneys, our Commercial Law team works with businesses to ensure contracts are clear, balanced and aligned with their commercial objectives, helping clients move forward with confidence.

Before you sign your next agreement, ask yourself one question:

Do I fully understand what I'm agreeing to?

If the answer is anything other than "yes", it's worth seeking legal advice.

Need your contract reviewed, get in touch with our legal team of experts.

"They haven't paid rent in months... why can't I just change the locks?"

It's one of the most common questions property owners ask, but under South African law, the answer is rarely straightforward.

Eviction is about far more than proving ownership or cancelling a lease. Our courts are required to balance the constitutional rights of property owners and occupiers, carefully considering whether an eviction is just and equitable in light of all the relevant circumstances.

Taking matters into your own hands by changing locks, disconnecting utilities or attempting to force an occupier out without following the correct legal process is not only unlawful, but can also result in costly delays and additional legal consequences.

In this article, Dévan Steyn explores the constitutional principles that underpin South Africa's eviction laws, explains why every eviction matter must be considered on its own facts, and highlights why obtaining legal advice early is often the key to achieving a lawful and successful outcome.

"What counts in life is not the mere fact that we have lived. It is what difference we have made to the lives of others." – Nelson Mandela

On Nelson Mandela Day, we honour the legacy of a leader who dedicated his life to justice, equality and the protection of human rights.

As legal professionals, we are reminded that the law is about more than legal processes and legislation. It is about serving people with integrity, advocating for fairness and helping build a society founded on justice and respect.

Today, we encourage everyone to embrace the spirit of Madiba by making a positive difference, no matter how big or small. Every act of kindness, service and compassion contributes to a stronger and more united South Africa.

From all of us at EY Stuart Attorneys, we wish you a meaningful Nelson Mandela Day.

Buying or selling property? One of the biggest surprises for many buyers and sellers is discovering who is actually responsible for the legal costs involved.

From transfer costs and conveyancing fees to rates clearance certificates and estate agent commission, understanding these expenses before signing an Offer to Purchase can help you avoid unexpected costs and make informed decisions.

In this month's Property Law Insight, Ona Nell, Director at EY Stuart Attorneys, shares practical guidance on how these costs are typically allocated and why it's important to understand your financial obligations before your property transaction begins.

Divorce proceedings can take months to conclude, but financial commitments and parenting responsibilities don't simply pause while you wait.

A Rule 43 application allows the court to consider temporary arrangements during a pending High Court divorce. Depending on the circumstances, this may include interim maintenance, temporary care and contact arrangements for children, and a contribution towards legal costs.

Every family's circumstances are different, and the appropriate legal approach will depend on the facts of your matter.

If you're going through a divorce and would like to understand your legal options, the Family Law team at EY Stuart Attorneys is here to help.
