Public schools can't suspend or expel a learner over their parents' unpaid fees. The law gives them a different remedy entirely.

Private schools have more contractual freedom, but our courts have made it clear that freedom has limits. A child's right to education doesn't disappear because of a payment dispute.

But that could be about to change. A recent court ruling found this exclusion unfair, especially for spouses who supported the household but built up no pension of their own. The ruling still needs final confirmation from the Constitutional Court before it takes effect.

If it's confirmed, pensions could become part of what's shared when these marriages end.

Any information you submit to SARS is covered by strict confidentiality rules under the Tax Administration Act. SARS officials, past or present, aren't allowed to share it, except in very limited circumstances.

Even the Constitutional Court has weighed in. It confirmed confidentiality remains the default. Disclosure only happens in rare cases where a strong public interest is at stake.

So no, SARS can't just hand over your tax details to anyone who asks.

Since July 2025, Cape Town added three new charges to residential rates bills: a city-wide cleaning charge, a fixed water charge, and a fixed sewerage charge.

SAPOA and AfriForum took the City to court. They argued the charges were calculated the wrong way. Instead of billing for actual water and sewerage use, the City based the charges on property value.

The court agreed. It found the charges unlawful and invalid.

But there's a catch. The ruling only takes effect from 30 June 2026. It's not backdated. So charges collected before that date remain payable.

The bigger principle: municipalities can't disguise a tax as a service fee. Charges for services must relate to actual use, not property value.

Parents can agree on almost anything when it comes to maintenance. Payment amounts, due dates, even how costs increase each year.

But some clauses just won't hold up in court. Try to cut off maintenance at 18, for example, and that clause falls away. A child's right to support can outlast it.
