Local Rules Matter

📍 NOT EVERY PROPERTY COMPLIANCE REQUIREMENT IS THE SAME EVERYWHERE.

When buying or selling property in South Africa, it is important to understand that some compliance requirements can depend on where the property is situated.

Certain municipalities may have additional requirements relating to water or plumbing installations, while the terms of the Offer to Purchase may also place specific obligations on the parties.

That is why buyers and sellers should never simply assume that the certificates required for one property will automatically be identical for another.

Before transfer, establish:

• Which compliance certificates apply to the property
• Whether any municipal requirements apply
• Who is responsible for obtaining each certificate
• What the Offer to Purchase says about compliance documentation

The property, the location and the sale agreement all matter.

🔥⚡ GAS OR ELECTRIC FENCING AT THE PROPERTY? MAKE SURE THE RIGHT COMPLIANCE DOCUMENTATION IS IN PLACE.

Not every system in a home falls under the same Certificate of Compliance.

If a property has a gas installation or electric fencing, those installations may have their own compliance requirements and should be inspected and certified by the appropriately authorised or registered person responsible for that particular type of installation.

For sellers, this means identifying the relevant systems on the property early.

For buyers, it means understanding which certificates should form part of the transaction and what those certificates relate to.

The conveyancing attorney manages the legal transfer process, but the technical inspection and certification remain the responsibility of the qualified person issuing the relevant CoC.

Don’t wait until transfer is already under pressure to establish what is required.

Electrical CoC: Don’t Leave It Until the Last Minute

⚡ SELLING YOUR HOME? DON’T LEAVE THE ELECTRICAL CoC UNTIL THE LAST MINUTE.

An Electrical Certificate of Compliance (CoC) is an important part of many South African property transactions and confirms that the electrical installation has been inspected against the applicable safety requirements.

For sellers, arranging the inspection early gives you time to deal with any defects that may be identified before they become a last-minute obstacle in the transfer process.

Remember, the purpose of the inspection is not simply to obtain a piece of paper. The electrician issuing the certificate is responsible for inspecting and certifying the electrical installation concerned.

If you are preparing to sell your property, speak to your conveyancer early so that you understand what documentation will be required and when.
