⚖️ DID YOU KNOW?

You are still very, very married, even though it’s 1 September 2026 and you missed the deadline to register your customary marriage? 😂💍

I know some of you were hoping that once 31 August 2026 passed, your customary marriage would somehow disappear and you would wake up this morning automatically divorced. 😂

Unfortunately, no such shortcut exists.

If your customary marriage was validly concluded, missing the registration deadline does not automatically dissolve your marriage.

And if you want to end your customary marriage, there are NO SHORTCUTS — it must be dissolved by a court of law. ⚖️

It’s 1 September 2026 and guess what? 👀

Your customary marriage is STILL intact! 😂⚖️

I know some of you were hoping that missing the 31 August 2026 registration deadline would magically result in an automatic divorce. Unfortunately… not quite! 😂

An unregistered customary marriage does not automatically disappear or become invalid simply because it was not registered by the deadline.

And if you want to end your customary marriage, there are NO shortcuts.

💍➡️⚖️ A customary marriage must be dissolved by a court of law.

You cannot simply decide that the marriage is over, declare yourself divorced, or assume that you are free to marry someone else.

So, if you were hoping to wake up this morning and discover that you are suddenly single… sorry! 😂

If you are uncertain about your marital status or the legal consequences of your customary marriage, get proper legal advice before making any decisions.

DID YOU KNOW? ⚖️

With the 31 August 2026 deadline approaching, there are still many questions about the registration of customary marriages. Let’s clarify the position.

Under the Recognition of Customary Marriages Act 120 of 1998, a customary marriage should ordinarily be registered within three months after the conclusion of the marriage, or within such longer period as may be prescribed.

However, many customary marriages were never registered within the prescribed period.

As a result, an extended period was provided to allow people whose customary marriages had not been registered within the prescribed period to come forward and register them.

The current extended period runs until 31 August 2026.

Now, PLEASE understand this part:

31 August 2026 is NOT the date on which your customary marriage expires. 😭

If you have a valid customary marriage and you fail to register it by 31 August 2026, you do not suddenly become unmarried on 1 September 2026.

The Recognition of Customary Marriages Act specifically provides that the failure to register a customary marriage does not affect the validity of the marriage.

Registration and the validity of the marriage are therefore two different things.

And please don’t make the mistake of saying:

“My customary marriage was never registered, therefore I am free to marry someone else.” 🤦🏾‍♀️

NO.

A valid customary marriage is not dissolved simply because it was not registered. A court divorce order is required to dissolve the marriage.

So before you enter into another marriage, deal with your existing marriage properly and obtain professional legal advice.

When it comes to matters as important as your marital status and legal rights, please ensure that you obtain proper legal advice from a qualified Legal Practitioner. ⚖️
