MYTH: A verbal agreement has no legal standing in South Africa. 🤔
TRUTH: That is not entirely correct.

Verbal agreements can be legally binding — but proving them is the challenge.

For example, if you lend a friend R5,000 and agree verbally that they will pay you back in 30 days, that is a valid contract. The problem arises when there is a dispute and no written record exists.

Some agreements MUST be in writing to be valid — like property sales, antenuptial contracts, and suretyship agreements. But many everyday agreements are enforceable even without a written document.

The lesson? Always get it in writing — even if it's just a WhatsApp confirmation.

As a sectional title owner, you have rights AND responsibilities:

✅ Responsibility to pay monthly levies
✅ Right to enforce the conduct rules
✅ Responsibility to maintain your unit

Is money being deducted from your salary without your full understanding? It could be an illegal garnishee order.

A garnishee order — or emoluments attachment order — allows a creditor to collect debt directly from your employer. But not all of them are legal.

A garnishee order may be unlawful if:
🔴 You were not properly notified
🔴 It was granted in the wrong court jurisdiction
🔴 The deduction amount is excessive and leaves you without enough to live on
🔴 The debt has already been paid

You have the right to challenge an unlawful garnishee order.

Retrenchment and dismissal are not the same thing — and the difference matters. 📋

🔴 Dismissal is when an employer terminates your employment due to misconduct or poor performance.

🟡 Retrenchment is when your position is eliminated for operational reasons — budget cuts, restructuring, or reduced workload. It is not your fault.

If you are being retrenched, your employer must:
✅ Consult with you meaningfully
✅ Consider alternatives before retrenching
✅ Pay you a retrenchment package as required by the Labour Relations Act

Do not sign any documents before you understand what you are agreeing to.
