Getting divorced? Your pension may form part of the settlement — in either direction. 💼

This surprises a lot of people. Depending on how you are married, one spouse can have a claim to a portion of the other’s pension, provident or retirement annuity fund.

What you need to know:
✅ It depends on your marriage contract — in community, out of community, or with accrual
✅ The claim must be properly worded in the divorce order, or the fund will not pay it out
✅ The fund must be named correctly — a vague reference is not enough
✅ Getting this wrong means going back to court later to fix it

✅ Transfer duty — paid to SARS on most properties above a certain value
✅ Transfer attorney fees — for registering the property in your name
✅ Bond registration costs — a separate process with its own attorney and its own fees
✅ Deeds Office fees and F**A costs
✅ Rates and levies paid in advance to the municipality or body corporate

These are not optional extras. You must pay them before the property can be registered in your name, and you can't add them to your home loan.

Retiring soon? Your restraint of trade may still follow you. 💼

A branch manager retired after nearly 18 years. Just before he left, a competing business was registered in his sons' names — operating from his home address.

He denied any involvement. The court found his fingerprints were all over it.

The ruling confirms something many people get wrong: how your employment ends does not release you from a restraint of trade. Resignation, dismissal, retrenchment or retirement — it can still apply.

Your employer has been liquidated. What happens to your job and your salary? 💼

This is one of the most frightening things that can happen to a worker — and most people have no idea where they stand.

Here is what you need to know:
✅ Your employment contract is suspended, not immediately ended
✅ A liquidator is appointed and may terminate contracts after a set period
✅ You can claim from the UIF — do not wait to do this
✅ For a limited portion of what you are owed in salary, leave and severance, employees rank ahead of most other creditors
✅ You must lodge your claim with the liquidator — it does not happen automatically

The biggest mistake employees make is assuming there is nothing they can do. There usually is, but there are deadlines.

Going to Small Claims Court? Winning comes down to how well you prepare. ⚖️

You do not need a lawyer, and it costs almost nothing — but people still lose cases they should have won, simply because they walked in unprepared.

Here is what makes the difference:
✅ Send a written letter of demand first — you cannot proceed without it
✅ Bring every document: contracts, invoices, receipts, quotes, photos
✅ Print your WhatsApp messages and emails — screenshots on a phone are hard to work with
✅ Bring witnesses if someone else saw what happened
✅ Write down your version in order, so you do not forget anything in front of the Commissioner
✅ Stick to the facts — the Commissioner wants evidence, not emotion

Note that some matters cannot be heard in Small Claims Court, including divorce and defamation claims.

Received a summons? The clock starts the day it is delivered. ⏰

A summons is not a letter of demand or a warning. It means legal action has already started against you.

Here is what most people get wrong:
🔴 Ignoring it does not make it go away — it makes it worse
🔴 If you do not respond in time, the other side can get judgment against you without you ever setting foot in court
🔴 That judgment can lead to your salary being attached, your assets sold, and your credit record affected

You usually have around 10 court days to file a notice of intention to defend, but check the summons itself — the exact period is stated on it.

Even if you owe the money, responding gives you options. Silence gives you none.

You paid a developer to build your software. That does not mean you own it. 💻

Under South African law, when an employee creates something as part of their job, the business owns it. But when an independent contractor or freelancer creates it, the copyright stays with them — unless there is a signed written agreement saying otherwise.
