This picture of a chicken walking into a KFC is just funny… but then it hits differently. Because KFC is in the business of frying chickens.
Which means that the chicken didn’t just walk into an interview, it walked straight into its own outcome.

And that’s the real lesson.

Lack of preparation is not just about being unable to answer questions. Sometimes, it means you don’t even understand the nature of the opportunity you are walking into.

In law, we see this often:
- entering into agreements without understanding the risks
- signing contracts without appreciating the implications
- stepping into situations that were avoidable with a bit of diligence

And for those of us in practice, it goes even further. We have seen matters where a party confidently proceeds with litigation or signs a deal, only to realise too late that the facts, the law or the forum were fundamentally against them.

By the time counsel is briefed or the papers are drafted, the “KFC moment” has already happened, the outcome was baked in long before the first appearance in court.

Had the chicken done its research, it would have realised that this is not an opportunity… this is a threat.

Courage is important. Showing up matters. But preparation is what tells you whether you should show up at all.

Because sometimes the issue is not how you perform in the room… it’s whether you should have entered the room in the first place.
And sometimes, by the time you understand the situation, you are no longer negotiating, you are already on the menu 😋.

This definition of a lawyer nearly killed me with laughter… 😄

There’s something both fascinating and terrifying about how some people perceive lawyers. I came across this “definition of a lawyer” recently and it had me in stitches, mostly because it’s painfully accurate.

Apparently, we are always right.
No - we just give almost accurate advice… based on the moving target called “facts.”

And yes, we do write 10 000-word documents and call them briefs.
It’s not about verbosity…it’s about precision.
A brief isn’t measured by word count; it’s defined by purpose.
It’s about setting out every instruction, every argument, and every fact from every possible angle to ensure the “brief is understood” … and cannot be misunderstood.

Clients come to us with stories that sound like movie scripts, missing evidence, emotional fog, and dramatic twists. We dig through it all, separate fact from fiction, and find that elusive line between what’s legal, what’s fair, and what’s just human.

Sometimes we are magicians, pulling legal rabbits out of statutory hats - finding creative solutions hidden deep within the law when it seems all options are gone.

Sometimes we are translators, turning human chaos into legal language. And sometimes, we are therapists, nodding through rants, decoding texts and politely saying, “That’s not how contracts work.”

So, instead of calling us people who do “precision guesswork based on unreliable data,” I would say we do precision work despite unreliable data usually provided by clients who don’t fully understand their own instructions (no offence, of course 😄).

And then there’s the part that says lawyers “solve problems you didn’t know you had in a way you don’t understand.”
Well… true. You come to us for a simple NDA, and somehow, we have protected your intellectual property, secured your payment rights and prevented future lawsuits, all before lunch.

Should you complain? Or should you be grateful that we stop problems before they even exist?

You may not always understand everything we do, that’s okay. Half the time, we barely understand why we keep doing it either… but we love it.

We turn chaos into certainty. And even when we are buried under files, cross-eyed from pages and pages of case law, or sipping our fourth coffee at 2 a.m., we still believe, deeply, that words can protect people.

So yes, call us magicians. Call us wizards. Call us trouble solvers.

But most importantly, call us when things go wrong… because chances are, we already know how they will go wrong. 😄⚖️

Deadlines Matter

This week I had the opportunity to represent an employer at the CCMA in an application for condonation. The case reminded me of a fundamental principle in employment law: condonation is not there for the taking.

- Even a short delay in referring a dispute must be fully explained, day by day.
- Reliance on representatives (unions, insurers, or attorneys) does not excuse non-compliance, employees remain responsible.
- Commissioners are often faced with a difficult balance: protecting access to justice for employees, while safeguarding employers’ right to finality.

The matter was resolved by settlement, but the key takeaway for me is that time limits in labour law are there for a reason. They bring certainty, protect both parties and uphold the principle of expeditious dispute resolution.

I am grateful for the trust placed in me to handle this matter and encouraged by the outcome. Each case is a learning opportunity and this one reaffirmed the importance of diligence, preparation, and respecting statutory timelines.
