VERSTAAN TRUSTS: Wat is dit en wanneer het jy een nodig?

’n Trust bestaan wanneer die skepper van die trust (gewoonlik die stigter) die beheer van ’n bate/s, of die opbrengs daarvan, oordra of verplig is om dit oor te dra aan iemand anders (die trustee) wat dit in sy/haar hoedanigheid as trustee bestuur namens of ten bate van ’n derde party (begunstigde) of ’n doel anders as vir die voordeel van die trustee self.

Die twee mees prominente trustinstrumente waardeur trusts geskep word, is:
•Inter vivos trusts – geskep tydens die leeftyd van die stigter deur middel van ’n geskrewe trustakte.
•Testamentêre trusts – geskep by die dood van die stigter deur middel van ’n testament.

Die Hoogste Hof van Appèl het erken in die bekende hofsaak van Land and Agricultural Bank of South Africa v Parker 2005 (2) SA 77 SCA, dat trusts oorspronklik ontwerp is met die doel om die begunstigdes te beskerm, en die belange van ‘n afwesige of oorlede persoon te beveilig. Trusts het egter ontwikkel tot ’n regsmeganisme vir ’n wye reeks omstandighede, en jy mag dit nodig hê in die volgende gevalle:
✅ Beskerm en bewaar jou bates
✅ Verseker besigheids of familiewelvaartkontinuïteit
✅ Sorg vir begunstigdes

UNDERSTANDING TRUSTS: What are they and when might you need one?

A trust exists when the creator of the trust (typically the founder) hands over or is obliged to hand over the control of an asset which, or the proceeds of which, is to be administered by another (the trustee) in his/her capacity as such on behalf of or for the benefit of a third person (beneficiary) or some object other than the benefit of the trustee.

The two most prominent trust instruments in which trusts are created are by means of:
•Inter vivos trusts – created during the lifetime of the founder by means of a written agreement.
•Testamentary trust – created upon death of the founder by means of a will.

The Supreme Court of Appeal acknowledged in the court case of Land and Agricultural Bank of South Africa v Parker 2005 (2) SA 77 SCA the position that trusts were designed with the main aim to protect beneficiaries and to safeguard the interests of those who are absent or deceased. However, trusts have become a legal instrument in a very wide range of circumstances, and you might need a trust in the following circumstances:
