What happens when a property seller passes away before transfer is registered? The agreement does not fall away under South African law.

If the sale was validly concluded, it remains binding on the parties even after the seller’s death. The process does not end there, but it does change.

The seller’s estate must first be reported to the Master of the High Court. An executor is then appointed to administer the estate and take control of the deceased’s obligations.

Once appointed, the executor effectively replaces the seller for purposes of the transaction. The executor is responsible for signing the necessary transfer documents to give effect to the sale.

Before the transfer can be finalised, the conveyancers must also obtain the Master’s consent after the executor has signed the required authority.

Only once this approval is granted can the transfer proceed in the normal way and be registered in the purchaser’s name.

While this process may cause delays and additional steps, the sale itself remains legally enforceable from start to finish.
