𝗪𝗵𝗮𝘁 𝗱𝗼 𝘁𝗵𝗲 𝗻𝗲𝘄 𝗿𝘂𝗹𝗲𝘀 𝗿𝗲𝗾𝘂𝗶𝗿𝗲?

The regulations introduce an official National Consumer Commission (NCC) “Opt-Out Registry”, where consumers can block unsolicited direct marketing communications.

Estate agencies conducting direct marketing must now:
✔ Register with the NCC as direct marketers
✔ Pay the prescribed registration and annual renewal fees
✔ Cleanse marketing databases monthly
✔ Remove consumers who opted out of direct marketing
✔ Clearly identify the agency in all marketing communications

Importantly, these regulations operate alongside POPIA and do not replace existing data protection obligations.

Non-compliance may lead to compliance notices, administrative penalties, and substantial fines.
